Since our last article on the draft Fertiliser Regulations in July there have been some developments. The Fertiliser Regulations appeared in the Official Journal of the European Union on the 25th June 2019 and therefore came into force 20 days later on 8th July 2019. The regulation shall apply from 16 July 2022 and the ratified regulations may be found here (Fertiliser Regulations (EU) 2019_1009).
However, there are exceptions to this date to allow for preparation for the new legislation.
The first are Articles 4(3), 14 and 42 to 47, which shall apply from 15 July 2019. Article 4(3) informs that by 16 July 2020 a guidance document on the appearance of the label will be published. Article 14 deals with the potential requirement to lay down acts covering the Conformity Assessments. Articles 42 to 47 covers the Commission’s delegated powers to amend the annexes of the Conformity Assessments.
The other exceptions are Articles 20 to 36, which shall apply from 16 April 2020. These outline the procedures for setting up Notifying Authorities and the rules governing Notified Bodies undertaking the Conformity Assessments.
