Biocidal Product Regulation in the UK Post ‘Brexit’

An update was provided on March 21st 2018 by the CRD EU Exit Unit regarding the Health and Safety Executive (HSE) Chemicals Regulation Division (CRD) approach to Biocidal Product regulation in the UK post ‘Brexit’ on March 29th 2019. The status update as it stands, without an EU level agreement in place:

  • There will be a UK Regulation for Biocides which is expected to be similar to the current Regulation EU 528/2012 (BPR) but there may be room to make some changes for the UK.

  • The UK will mutually recognise any BPR authorisation from the EU, but there is no guarantee as yet that this will work in the reverse.

  • The UK will not be involved in any Union level business.

  • It is not clear how the Active Substance review programme, will be transposed in the UK.

  • Any extant UK BPR authorisations will remain valid.

  • Ongoing evaluation of BPR applications for the UK market will continue.

  • There is no guarantee how applications will be made to the UK post ‘Brexit’, for example the use of IUCLID and R4BP.
